  12. FILES. IT MAY NOT BE REMOVED OR MODIFIED. THIS INFORMATION PERTAINS TO ALL 
  13. USE OF THE PACKAGE WORLDWIDE.  THIS DOCUMENT SUPERSEDES ALL PREVIOUS 
  14. GENERAL LICENSES OR DISTRIBUTION POLICIES. ANY INDIVIDUALS, COMPANIES OR 
  15. GROUPS WHO HAVE BEEN GRANTED SPECIAL LICENSES MAY CONTINUE TO DISTRIBUTE 
  16. VERSION 2.x BUT MUST RE-APPLY FOR VERSION 3.00 OR LATER.

  18. This document pertains to the use and distribution of the Persistence of 
  19. Vision(tm) Ray Tracer a.k.a POV-Ray(tm). It applies to all POV-Ray program 
  20. source files, executable (binary) files, scene files, documentation files, 
  21. help file, bitmaps and INI files contained in official POV-Ray Team(tm) 
  22. archives.  All of these are referred to here as "the software". 
  23.  
  24. All of this software is Copyright 1991,1997 by the POV-Ray Team(tm).  
  25. Although it is distributed as freeware, it is NOT PUBLIC DOMAIN.
  26.  
  27. The copyrighted package may ONLY be distributed and/or modified according 
  28. to the license granted herein.  The spirit of the license is to promote 
  29. POV-Ray as a standard ray tracer, provide the full POV-Ray package freely 
  30. to as many users as possible, prevent POV-Ray users and developers from 
  31. being taken advantage of, enhance the life quality of those who come in 
  32. contact with POV-Ray.  This license was created so these goals could be 
  33. realized.  You are legally bound to follow these rules, but we hope you 
  34. will follow them as a matter of ethics, rather than fear of litigation.

  37.                              USAGE PROVISIONS
  38.  
  39. Permission is granted to the user to use the software and associated files 
  40. in this package to create and render images. The use of this software for 
  41. the purpose of creating images is completely free. The creator of a scene 
  42. file and the image created from the scene file, retains all rights to the 
  43. image and scene file they created and may use them for any purpose 
  44. commercial or noncommercial.  
  45.  
  46. The user is also granted the right to use the scenes files, fonts, bitmaps, 
  47. and include files distributed in the INCLUDE, TEXSAMPS and POV3DEMO sub-
  48. directories in their own scenes.  Such permission does not extend to files 
  49. in the POVSCN sub-directory.  POVSCN files are for your enjoyment and 
  50. education but may not be the basis of any derivative works.

  53.                     GENERAL RULES FOR ALL DISTRIBUTION
  54.  
  55. The permission to distribute this package under certain very specific 
  56. conditions is granted in advance, provided that the following conditions 
  57. are met.  
  58.  
  59. These archives must not be re-archived using a different method without the 
  60. explicit permission of the POV-Team.  You may rename the archives only to 
  61. meet the file name conventions of your system or to avoid file name 
  62. duplications but we ask that you try to keep file names as similar to the 
  63. originals as possible.  (For example:POVSRC.ZIP to POVSRC30.ZIP)

  65. Ready-to-run unarchived distribution on CD-ROM is also permitted if the 
  66. files are arranged in our standard directory or folder structure as though 
  67. it had been properly installed on a hard disk.

  69. You must distribute a FULL PACKAGE of files as described in the next 
  70. section.  No portion of this package may be separated from the package and 
  71. distributed separately other than under the conditions specified in the 
  72. provisions given below.

  74. Non-commercial distribution in which no money or compensation is charged 
  75. (such as a user copying the software for a personal friend or colleague) is 
  76. permitted with no other restrictions.  
  77.  
  78. Teachers and educational institutions may also distribute the material to 
  79. students and may charge minimal copying costs if the software is to be used 
  80. in a course.

  83.                        DEFINITION OF "FULL PACKAGE"
  84.  
  85. POV-Ray is contained in two sets of archives for each hardware platform.  
  86. A "full package" consists of either:
  87.  
  88.       1) End user executable archives containing an executable program,
  89.          documentation, and sample scenes but no source.
  90.  
  91.                                   - or -
  92.  
  93.       2) Programmer archives containing full source code but no executable.  
  94.          Also you must include an archive containing documentation, and
  95.          sample scenes.  On some platforms, the documentation and sample
  96.          scenes are archived separately from the source.  Source alone
  97.          is not sufficient.  You must have docs and scenes.
  98.  
  99. POV-Ray is officially distributed for MS-Dos; Windows 32-bit; Linux for 
  100. Intel x86 series; Apple Macintosh; Apple PowerPC; SunOS; and Amiga.  Other 
  101. systems may be added in the future.
  102.  
  103. Distributors need not support all platforms but for each platform you 
  104. support you must distribute a full package.  For example a Macintosh only 
  105. BBS need not distribute the Windows versions.
  106.  
  107. This software may ONLY be bundled with other software packages according to 
  108. the conditions specified in the provisions below.

  111.          CONDITIONS FOR SHAREWARE/FREEWARE DISTRIBUTION COMPANIES
  112.  
  113. Shareware and freeware distribution companies may distribute the software 
  114. included in software-only compilations using media such as, but not limited 
  115. to, floppy disk, CD-ROM, tape backup, optical disks, hard disks, or memory 
  116. cards.  This section only applies to distributors of collected programs.  
  117. Anyone wishing to bundle the package with a shareware product must use the 
  118. commercial bundling rules.  Any bundling with books, magazines or other 
  119. print media should also use the commercial rules.
  120.  
  121. You must notify us that you are distributing POV-Ray and must provide us 
  122. with information on how to contact you should any support issues arise. 
  123.  
  124. No more than five dollars U.S. ($5) can be charged per disk for the copying 
  125. of this software and the media it is provided on. Space on each disk must 
  126. be used as fully as possible.  You may not spread the files over more disks 
  127. than are necessary.

  129. Distribution on high volume media such as backup tape or CD-ROM is 
  130. permitted if the total cost to the user is no more than $0.08 U.S. dollars 
  131. per megabyte of data.  For example a CD-ROM with 600 meg could cost no more 
  132. than $48.00.

  135.        CONDITIONS FOR ON-LINE SERVICES AND BBS'S INCLUDING INTERNET
  136.  
  137. On-line services, BBS's and internet sites may distribute the POV-Ray 
  138. software under the conditions in this section.  Sites which allow users to 
  139. run POV-Ray from remote locations must use separate provisions in the 
  140. section below.
  141.  
  142. The archives must all be easily available on the service and should be 
  143. grouped together in a similar on-line area.  
  144.  
  145. It is strongly requested that sites remove prior versions of POV-Ray to 
  146. avoid user confusion and simplify or minimize our support efforts.
  147.  
  148. The site may only charge standard usage rates for the downloading of this 
  149. software. A premium may not be charged for this package. I.E. CompuServe or 
  150. America On-Line may make these archives available to their users, but they 
  151. may only charge regular usage rates for the time required to download.

  153.  
  154.                    ONLINE OR REMOTE EXECUTION OF POV-Ray
  155.  
  156. Some internet sites have been set up so that remote users can actually run 
  157. POV-Ray software on the internet server.  Other companies sell CPU time for 
  158. running POV-Ray software on workstations or high-speed computers.  Such use 
  159. of POV-Ray software is permitted under the following conditions.
  160.  
  161. Fees or charges, if any, for such services must be for connect time, 
  162. storage or processor usage ONLY.  No premium charges may be assessed for 
  163. use of POV-Ray beyond that charged for use of other software.  Users must 
  164. be clearly notified that they are being charged for use of the computer and 
  165. not for use of POV-Ray software. 
  166.  
  167. Users must be prominently informed that they are using POV-Ray software, 
  168. that such software is free, and where they can find official POV-Ray 
  169. software.  Any attempt to obscure the fact that the user is running POV-Ray 
  170. is expressly prohibited.  
  171.  
  172. All files normally available in a full package distribution, especially a 
  173. copy of this license and full documentation must be available for download 
  174. or readable online so that users of an online executable have access to all 
  175. of the material of a full user package.
  176.  
  177. If the POV-Ray software has been modified in any way, it must also follow 
  178. the provisions for custom versions below.

  181.               CONDITIONS FOR DISTRIBUTION OF CUSTOM VERSIONS
  182.  
  183. The user is granted the privilege to modify and compile the source code for 
  184. their own personal use in any fashion they see fit.  What you do with the 
  185. software in your own home is your business.

  187. If the user wishes to distribute a modified version of the software, 
  188. documentation or other parts of the package (here after referred to as a 
  189. "custom version") they must follow the provisions given below.  This 
  190. includes any translation of the documentation into other languages or other 
  191. file formats.  These license provisions have been established to promote 
  192. the growth of POV-Ray and prevent difficulties for users and developers 
  193. alike.  Please follow them carefully for the benefit of all concerned when 
  194. creating a custom version.

  196. No portion of the POV-Ray source code may be incorporated into another 
  197. program unless it is clearly a custom version of POV-Ray that includes all 
  198. of the basic functions of POV-Ray.

  200. All executables, documentation, modified files and descriptions of the same 
  201. must clearly identify themselves as a modified and unofficial version of 
  202. POV-Ray.  Any attempt to obscure the fact that the user is running POV-Ray 
  203. or to obscure that this is an unofficial version expressly prohibited.

  205. You must provide all POV-Ray support for all users who use your custom 
  206. version.  You must provide information so that user may contact you for 
  207. support for your custom version.  The POV-Ray Team is not obligated to 
  208. provide you or your users any technical support.
  209.  
  210. Include contact information in the DISTRIBUTION_MESSAGE macros in the 
  211. source file OPTOUT.H and insure that the program prominently displays this 
  212. information.  Display all copyright notices and credit screens for the 
  213. official version.
  214.  
  215. Custom versions may only be distributed as freeware.  You must make all of 
  216. your modifications to POV-Ray freely and publicly available with FULL 
  217. SOURCE CODE to the modified portions of POV-Ray and must freely distribute 
  218. full source to any new parts of the custom version.  The goal is that users 
  219. must be able to re-compile the program themselves and to be able to further 
  220. improve the program with their own modifications.

  222. You must provide documentation for any and all modifications that you have 
  223. made to the program that you are distributing.  Include clear and obvious 
  224. information on how to obtain the official POV-Ray.
  225.  
  226. The user is encouraged to send enhancements and bug fixes to the POV-Ray 
  227. Team, but the team is in no way required to utilize these enhancements 
  228. or fixes.  By sending material to the team, the contributor asserts that 
  229. he owns the materials or has the right to distribute these materials.  
  230. He authorizes the team to use the materials any way they like.  The 
  231. contributor still retains rights to the donated material, but by donating, 
  232. grants unrestricted, irrevocable usage and distribution rights to the 
  233. POV-Ray Team. The team doesn't have to use the material, but if we do, 
  234. you do not acquire any rights related to POV-Ray.  The team will give you 
  235. credit as the creator of new code if applicable.

  240.                     CONDITIONS FOR COMMERCIAL BUNDLING
  241.  
  242. Vendors wishing to bundle POV-Ray with commercial software (including 
  243. shareware) or with publications must first obtain explicit permission from 
  244. the POV-Ray Team.  This includes any commercial software or publications, 
  245. such as, but not limited to, magazines, cover-disk distribution, books, 
  246. newspapers, or newsletters in print or machine readable form.
  247.  
  248. The POV-Ray Team will decide if such distribution will be allowed on a 
  249. case-by-case basis and may impose certain restrictions as it sees fit. 
  250. The minimum terms are given below. Other conditions may be imposed.
  251.  
  252.       Purchasers of your product must not be led to believe that they are 
  253. paying for POV-Ray.  Any mention of the POV-Ray bundle on the box, in 
  254. advertising or in instruction manuals must be clearly marked with a 
  255. disclaimer that POV-Ray is free software and can be obtained for free or 
  256. nominal cost from various sources.
  257.       Include clear and obvious information on how to obtain the official 
  258. POV-Ray.
  259.       You must provide all POV-Ray support for all users who acquired POV-
  260. Ray through your product.  The POV-Ray Team is not obligated to provide 
  261. you or your customers any technical support.
  262.       Include a credit page or pages in your documentation for POV-Ray.
  263.       If you modify any portion POV-Ray for use with your hardware or 
  264. software, you must follow the custom version rules in addition to these 
  265. rules.
  266.       Include contact and support information for your product.
  267.       Include a full user package as described above.

  270.                        RETAIL VALUE OF THIS SOFTWARE
  271.  
  272. Although POV-Ray is, when distributed within the terms of this agreement, 
  273. free of charge, the retail value (or price) of this program is determined 
  274. as US$20.00 per copy distributed or copied. If the software is distributed 
  275. or copied without authorization you are legally liable to this debt to the 
  276. copyright holder or any other person or organization delegated by the 
  277. copyright holder for the collection of this debt, and you agree that you 
  278. are legally bound by the above and will pay this debt within 30 days of the 
  279. event.

  281. However, none of the above paragraph constitutes permission for you to 
  282. distribute this software outside of the terms of this agreement. In 
  283. particular, the conditions and debt mentioned above (whether paid or 
  284. unpaid) do not allow you to avoid statutory damages or other legal 
  285. penalties and does not constitute any agreement that would allow you to 
  286. avoid such other legal remedies as are available to the copyright holder.

  288. Put simply, POV-Ray is only free if you comply with our distribution 
  289. conditions; it is not free otherwise. The copyright holder of this software 
  290. chooses to give it away free under these and only these conditions.

  292. For the purpose of copyright regulations, the retail value of this software 
  293. is US$20.00 per copy.

  296.                              OTHER PROVISIONS
  297.  
  298. The team permits and encourages the creation of programs, including 
  299. commercial packages, which import, export or translate files in the POV-Ray 
  300. Scene Description Language.  There are no restrictions on use of the 
  301. language itself.  We reserve the right to add or remove or change any part 
  302. of the language.
  303.  
  304. "POV-Ray", "Persistence of Vision", "POV-Ray Team" and "POV-Help" are 
  305. trademarks of the POV-Ray Team.  
  306.  
  307. While we do not claim any restrictions on the letters "POV" alone, we 
  308. humbly request that you not use POV in the name of your product.  Such use 
  309. tends to imply it is a product of the POV-Ray Team.  Existing programs 
  310. which used "POV" prior to the publication of this document need 
  311. not feel guilty for doing so provided that you make it clear that the 
  312. program is not the work of the team nor endorsed by us.

  315.                            REVOCATION OF LICENSE
  316.  
  317. VIOLATION OF THIS LICENSE IS A VIOLATION OF COPYRIGHT LAWS.  IT WILL RESULT 
  318. IN REVOCATION OF ALL DISTRIBUTION PRIVILEGES AND MAY RESULT IN CIVIL OR 
  319. CRIMINAL PENALTY.  
  320.  
  321. Such violators who are prohibited from distribution will be identified in 
  322. this document.

  324. In this regard, "PC Format", a magazine published by Future Publishing, 
  325. Ltd. in the United Kingdom, distributed incomplete versions of POV-Ray 1.0 
  326. in violation the license which was effect at the time.  They later 
  327. attempted to distribute POV-Ray 2.2 without prior permission of the POV-Ray 
  328. Team in violation the license which was in effect at the time.  There
  329. is evidence that other Future Publishing companies have also violated
  330. our terms.  Therefore "PC Format", and any other magazine, book or CD-ROM
  331. publication owned by Future Publishing is expressly prohibited from any
  332. distribution of POV-Ray software until further notice.

  338. Although the authors have attempted to find and correct any bugs in the 
  339. package, they are not responsible for any damage or losses of any kind
